Tenders are invited for Trailer parts according to specification for :Supply of musical instruments for carrying out educational activities within the high school of choreography and dramatic art octavian stroia cluj-napoca. the contract involves the purchase of musical instruments for teaching activities as follows: acoustic grand piano - 6 pieces professional acoustic piano - 3 pieces suspensive clause: the awarding/acquisition procedure is initiated under the present suspensive clause, in the sense that the conclusion of the public procurement contract is conditional on the provision of funds by the main authorizing officer, the municipality of cluj-napoca, the signing of the contract being done in compliance with the provisions regarding to the employment of expenses from the budgets that fall under the scope of the legislation on public finances. considering the provisions of law 98/2016 and hg no. 395/2016 with subsequent amendments and additions, the contracting authority specifies that it will conclude the contract with the tenderer declared the winner only to the extent that the funds necessary for the purchase will continue to be provided by the main credit authority. if, regardless of the reasons, the main authorizing officer will not grant the necessary funds, after receiving the notification from him regarding the non-granting of funding, the contracting authority reserves the right to cancel the award procedure, provided that there is no other source of funding, in accordance with the provisions of art. 212 paragraph 1 letter c from law 98/2016 with subsequent amendments and additions, it being impossible to conclude the public procurement contract. bidders in this procedure understand that the contracting authority and/or the main credit authorizing officer cannot be held liable for any damage in the event of the cancellation of the award procedure, regardless of its nature and regardless of whether the contracting authority and/or the main credit authorizing officer were notified of the existence of such damage. bidders within this procedure accept the use of the above special conditions/suspensive clause, assuming full responsibility in relation to any damages they may suffer in the described situation.
