Tenders are invited for General and emergency health consumables
The MH EK intends to procure general and emergency health consumables by concluding a framework agreement, based on Section 105 (1) a) of the Kbt. with one bidder. EU Regulation 2019/1020 Article 3 Definitions The total value of the framework agreement is a net amount of 865,604,065 HUF, through the conclusion of a framework agreement according to Section 105 (1) a) of the Kbt. The contracting authority is not obliged to carry out the procurement. Fulfillment: with multiple calls, multiple deliveries, with the possibility of issuing partial invoices. Additional Procurement Document hereinafter: KKD., Technical description. (X) (X) The bidder (AT) may only propose such product(s) that meet the following: - legally marketable in the member states of the European Union; - new (factory new, unused, not demo equipment); - manufactured according to the EU harmonized standards (in case of deviation with equivalent solutions) and the fundamental requirements of the directives. THE OFFER MUST CONTAIN: Professional offer: (1) In the framework of the OFFER, it must attach the product description supervised by the manufacturer or distributor for the proposed product (in copy). The product description supervised by the manufacturer or distributor must contain at least the name of the product, the name of the manufacturer, the place of origin of the product, as well as its technical parameters, characteristics, and all data and information from which the compliance of the product with the technical requirements specified in the procurement documents can be established. If the product description is not in Hungarian, the non-Hungarian document and its Hungarian translation must also be attached. The product description supervised by the manufacturer or distributor refers to the document summarizing the functional and technical parameters of the product issued by the direct manufacturer of the product, or the authorized representative for distribution, or in the case of a non-EU manufacturer, the manufacturer or EU-based authorized representative (EC REP). The contracting authority does not expect certification by the manufacturer or distributor, meaning that any product description/brochure from the manufacturer or distributor is acceptable. (2) The bidders declaration (COMPLIANCE DECLARATION) on how the proposed product meets the technical requirements set for the product to be procured. The declaration must be made in the commercial table (based on the data provided in the Technical description table), in knowledge of the technical requirement set for the product to be procured: in text, with numerical data, or with a yes/no statement. Commercial offer: (3) A commercial table (to support the proposed price), must be filled out based on the specified template. [KKD.7.3. point] It must include the name of the proposed product, its article number, manufacturer, country of origin, net and gross minimum unit price, total price, VAT rate, and packaging unit. The name of the proposed product, its article number, manufacturer, and the (net) unit price for the smallest unit will be treated as basic data by the contracting authority. The failure to attach the professional offer in the bid submitted before the opening will result in the INVALIDITY of the offer. An exception is made if the values defined as basic data in the PROFESSIONAL offer can be clearly and unequivocally established in other parts of the offer. (see KKD 7.3.2.). (X) The bidder must state in the offer that the proposed product meets the requirements of a medical device. If the proposed product qualifies as a medical device, the winning bidder is contractually obliged to prove the compliance of the proposed product as a medical device according to Section 9 (2) of Government Decree 16/2012. (II.16.). (X) The contracting authority states in the announcement IV.1.8. that the procedure falls under the GPA. Accordingly, Section 2 (5) of the Kbt. is applicable. According to Section 2 (5) of the Kbt., national treatment must be provided in the procurement procedure for economic operators established in the EU and for goods of community origin. National treatment for economic operators established outside the EU and for goods of non-community origin must be provided in accordance with Hungarys and the EUs international obligations in public procurement. In accordance with Section 74 (2) of the Kbt., the contracting authority may exclude from the procedure any bidder for whom national treatment is not required [Section 2 (5)]. The contracting authority does not exclude the bidder if the proposed products manufacturer qualifies as an economic operator established in the European Union and the European Economic Area according to point 8 of Article 3 of EU Regulation 2019/1020, and the proposed product complies with EU directives regardless of the place of origin. The bidder, considering the place of origin of the proposed product. 8. "manufacturer": a natural or legal person who manufactures a product, or has a product designed or manufactured, and markets the product under its own name or trademark; 9. "importer": a natural or legal person established in the Union who markets a product originating from a third country in the EU market; 10. "distributor": a natural or legal person in the supply chain other than the manufacturer or importer who markets the product.
