lot-0001, title: execution of construction works for the task "improving the accessibility of specialist outpatient care and rehabilitation at the mikolaj kopernik hospital in gdansk - stage i". description: 1. the subject of the order is construction works in the build formula for the task "improving the accessibility of specialist outpatient care and rehabilitation at the mikolaj kopernik hospital in gdansk" based on the design documentation attached to the description of the subject of the order (annex 1 to the swz). 2. the subject of the order consists of one part. the detailed scope and method of execution of the subject of the order is specified in annex no. 1 to the swz - description of the subject of the order (referred to as opz) along with attachments. the conditions for the execution of the order are included in annex no. 3 to the swz - draft contract with attachments. 3. the contractor will provide a guarantee covering the subject of this order for a period of at least 36 months, a maximum of 60 months (from the date of final acceptance of the works). definitions of acceptance and guarantee are described in annex no. 3 to the swz. the warranty period is one of the criteria for evaluating offers. 4. equivalent solutions: in all provisions of the swz and its attachments, where trademarks, parameters, sources, or a specific process characterizing products delivered by a specific contractor (names of manufacturers or devices) are indicated, in accordance with article 99(5) of the pzp act and when the subject of the order is described by reference to standards, technical assessments, technical specifications, reference systems, in accordance with article 101(4) of the pzp act, the ordering party allows equivalent solutions. 5. the ordering party does not reserve the possibility of applying for the order exclusively by contractors referred to in article 94 of the pzp act. 6. in connection with the execution of the order, the ordering party does not foresee the obligation of personal execution of key tasks of the order. 7. in connection with the execution of the order, the ordering party requires that the contractor and subcontractor employ persons performing construction works under the supervision of the construction manager or branch managers, provided they fall within article 22 § 1 of the act of june 26, 1974 - labor code (journal of laws of 2019, items 1040, 1043, and 1495). construction works performed under the supervision of the construction manager or branch managers are understood to mean all general construction works such as: installation (electrical, sanitary, telecommunication) and others from various fields resulting from the documentation performed directly by employees under the supervision of the construction manager or branch managers. 1) the ordering party will be entitled to control the contractor's compliance with the requirements regarding the employment of persons entrusted with the execution of the subject of the contract and, in the event of a violation by the contractor of this obligation, to notify the national labor inspectorate of such circumstances, 2) the contractor, no later than on the day of handing over the construction site, will provide a statement with information about the employment of foreigners along with a list of employed persons and confirmation of legal employment. the contractor will transfer this obligation to all subcontractors related to the execution of the contractor's contract. 3) the contractor, no later than on the day of handing over the construction site, will provide the ordering party with a list of persons employed under an employment contract. the contractor will transfer this obligation to all subcontractors related to the execution of the contractor's contract. 4) during the execution of the order, at the request of the ordering party within the deadline specified in this request, the contractor will submit to the ordering party the evidence indicated in the draft contract (7.31) to confirm compliance with the requirement for employment under an employment contract by the contractor or subcontractor of persons performing the above-mentioned activities during the execution of the order. 5) in case of any doubts regarding employment under an employment contract by the contractor or subcontractor, the ordering party is entitled to notify the relevant labor inspectorate and request an inspection in this regard, 6) the ordering party's rights regarding sanctions for non-compliance with the requirements specified in chapter iii point 8 of the swz are regulated in the contract template constituting annex no. 3 to the swz. 8. source of financing: ? partial financing from the funds of the european funds for pomerania (fep) 2021-2027 - project "improving the accessibility of specialist outpatient care and rehabilitation at the mikolaj kopernik hospital in gdansk - stage i", action 6.7. health infrastructure fep 2021-2027 in the area of developing one-day care and outpatient medical care ?
