Contract awarded for Design and execution of express road suceava – siret lot 1: suceava – darmane?ti lot 2: darmane?ti – balcau?i
lot-0001, title: design and execution of the express road suceava – siret lot 1: suceava – darmane?ti, description: the object of the contract represents the design and execution of works for lot 1 of the express road suceava - siret, with a length of approximately 18.6 km.
in accordance with the contractual provisions, namely h.g. no.1/2018, any changes that may occur during the execution of the contract refer to the following, without being limited to these:
1. changes of the contracting parties, including the replacement of the contractor with a new contractor under the conditions provided in art. 221 para. (1) lit. d), point (ii);
2. change of the name and/or form of the company, changes that do not lead to the creation of a new legal entity;
3. changes resulting from the adaptation of the technical execution project to the reality on the ground, including changes in specific technical solutions;
4. changes resulting from modifications/adaptations of the levels, positions, and/or dimensions of some works as a result of the situation on the ground;
5. changes generated by requirements of environmental authorities;
6. changes resulting from the need to relocate/move certain objects located on/in the ground/basement;
7. changes generated by the inclusion of new subcontractors/suppliers/subcontractors of subcontractors/any other economic operators and/or generated by the replacement of initial subcontractors/suppliers/subcontractors of subcontractors/any other economic operators, which will be carried out according to the corresponding clause in the general conditions of the contract;
8. changes generated by the change of key personnel/other personnel, which will be carried out according to the corresponding clause in the general conditions of the contract;
9. changes of the expropriation corridor that lead to the necessity of carrying out additional works and/or to the abandonment of carrying out some existing works in the contract;
10. changes generated by agreements, conventions, understandings of the state/local authorities with other states;
11. legislative changes or technical standards/norms/standards during the execution of the contract, which will be carried out according to the corresponding clause in the general conditions of the contract, respecting the provisions of art. 221 of law no. 98/2016, with subsequent amendments and completions;
12. extension of the execution duration based on the contractual mechanism provided in clause 35 [extension of the execution duration] of the general conditions without affecting the beneficiary's right to apply penalties and/or sanctions to the contractor as provided in the contract;
13. changes resulting from the implementation of requests from various institutions/authorities/entities that have responsibilities related to the investment objective (for example: ministries, jaspers, central and/or local authorities/institutions, certified verifiers, control bodies, etc.).
14. changes resulting from the discharge of archaeological burdens.
15. changes generated by changes in the land, surface and underground hydrographic networks unknown at the time of drafting the technical execution project;
the changes will be made after the signing of the contract, in accordance with the contractual provisions, only if they do not represent substantial changes in the sense of the provisions of art. 221 para. (7) of law no. 98/2016.
the extension of the execution duration will be carried out in accordance with the provisions of clause 35 [extension of the execution duration] of the general conditions. more information can be found in the contract.
lot-0002, title: design and execution of the express road suceava – siret lot 2: darmane?ti – balcau?i, description: the object of the contract represents the design and execution of works for lot 2 of the express road suceava - siret, with a length of approximately 24.45 km.
in accordance with the contractual provisions, namely h.g. no.1/2018, any changes that may occur during the execution of the contract refer to the following, without being limited to these:
1. changes of the contracting parties, including the replacement of the contractor with a new contractor under the conditions provided in art. 221 para. (1) lit. d), point (ii);
2. change of the name and/or form of the company, changes that do not lead to the creation of a new legal entity;
3. changes resulting from the adaptation of the technical execution project to the reality on the ground, including changes in specific technical solutions;
